Law firms want to prevent Trust Account overdrafts because overdrawing client funds can violate core fiduciary duties and can trigger immediate, severe regulatory penalties.
Amicus Billing by CARET offers a function to prevent Trust account overdraft.
Log into Amicus by CARET as an Administrator.
Go to the Office module.
Select Firm Settings.
Under the Billing section select Trust.
Under the Trust Overdraft Protection select one of the following options:
- Warn if New, Edit or Deletion of an Entry will cause Trust Overdraft
This allows the transactions but will notify the user performing the function that this would cause a Trust Overdraft. - Prevent Trust Overdraft
If an action is being performed which would results in a Trust Overdraft, Amicus Billing by CARET prevents the action from being completed.
Under the Create one Trust Transfer done at Billing for each: select one of the following options:
- Trust Bank Account
For Consolidated and Mass Billing, choosing this option creates a single check (for each Bank Account, for each AR date) for all Trust Transfers done at the time of posting the Bill. By choosing this option, the Trust Index will show the transaction as one lump sum entry rather than individual File entries, but each File will show the individual distribution. - File
For Consolidated and Mass Billing, choosing this option creates a separate check for the Trust Transfer done on each File.
